By accessing or using the DBSS (Digital Business System Solutions) platform, website (dbss.info), or any related services provided by DBSS LLC ("DBSS," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.

DBSS provides an all-in-one business management platform that includes CRM, marketing automation, website and funnel building, appointment scheduling, SMS/email marketing, AI-powered tools, reputation management, and related business solutions. Services are provided on a subscription basis as described in our pricing plans.

3. Account Registration

To use our platform, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring all information provided is accurate and up to date

4. SMS/Text Messaging Terms

By providing your phone number and consenting to receive SMS/text messages from DBSS, you acknowledge and agree to the following:

Consent: Your consent to receive SMS messages is not a condition of purchasing any goods or services. You may opt in or opt out at any time.

Message Types: Messages may include appointment reminders, promotional offers, service updates, account notifications, and follow-up communications.

Frequency: Message frequency varies. You may receive up to 10 messages per month depending on your account activity and preferences.

Costs: Message and data rates may apply based on your mobile carrier plan. DBSS is not responsible for any charges from your carrier.

Opt-Out: Reply STOP to any SMS message to opt out. You will receive a confirmation message and no further messages will be sent unless you re-subscribe.

No Third-Party Sharing: Your phone number and opt-in consent will not be sold, rented, or shared with any third parties for their marketing purposes.

5. Subscription and Billing

DBSS offers subscription plans billed on a monthly basis. By subscribing, you agree to:

• Pay the applicable subscription fees as listed on our pricing page
• Provide valid payment information through our secure payment processor (Stripe)
• Automatic renewal of your subscription at the end of each billing cycle unless cancelled
• A 14-day free trial period for new accounts (no credit card required to start)

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

6. Acceptable Use

You agree not to use our services to:

• Send unsolicited or spam messages (SMS, email, or otherwise)
• Violate any applicable laws, regulations, or industry standards (including TCPA, CAN-SPAM, and A2P messaging regulations)
• Infringe upon the intellectual property rights of others
• Transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the platform for any illegal, fraudulent, or deceptive purposes

7. Intellectual Property

All content, features, and functionality of the DBSS platform — including software, text, graphics, logos, and trademarks — are owned by DBSS LLC and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, DBSS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or completely secure. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms of Service or for any other reason at our sole discretion. Upon termination, your right to use the platform ceases immediately. You may request export of your data within 30 days of termination.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated through our platform or via email. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
